Please read the following terms and conditions carefully, as they govern the relationship between our company – ESJ Projects and you, the client.
1. Services
Our company will provide property maintenance services to the client, as outlined in the scope of work agreed upon by both parties or any third party engaged by the client at the time of engagement. We will use reasonable care and skill in carrying out the services.
2. Payment
The client agrees to pay our company in accordance with the payment terms outlined in the invoice. Payment is due within 7 days of the invoice date. If payment is not received within 7 days, a late fee of 10% of the outstanding amount will apply.
a) If payment is not made as per the above stated in 2, all outstanding payments will be referred to QCAT.
b) The client will be responsible for any cost incurred by the Company associated with the QCAT application; this also includes $150 per hour for the Companies time in court.
3. GST
All prices quoted by our company are inclusive of GST.
4. Quotations
All quotations provided by our company are valid for a period of 30 days from the date of issue. Our company reserves the right to amend the quotation if there are changes to the scope of work or if unforeseen circumstances arise during the provision of services.
5. Cancellations
If the client cancels a scheduled service within 24 hours of the agreed-upon start time, our company reserves the right to charge a cancellation fee of 50% of the quoted price.
6. Liability
Our company is insured for public liability and professional indemnity and will take reasonable care to prevent damage or loss to the client’s property during the provision of services. However, our company will not be liable for any loss or damage arising from circumstances beyond our control.
7. Termination
Either party may terminate this agreement by providing written notice to the other party. Termination will be effective immediately upon receipt of the notice.
8. Governing law
This agreement will be governed by the laws of Queensland, Australia.
9. Entire agreement
This agreement constitutes the entire agreement between the parties and supersedes all prior agreements, understandings, negotiations, and discussions between the parties relating to the provision of services. By engaging our company to provide property maintenance services, you agree to these terms and conditions.
